As a developing country, Malaysia’s need for infrastructure, both basic and incremental, has led to much growth in relevant industries over the last few decades and in turn to the firm’s experience and expertise whilst advising clients. The firm was there as the Malaysian counsel to the concessionaire of the first Light Rail Transit system in Malaysia way back in the 1990’s. That project was a good example of a Public-Private Partnership in Malaysia. Another PPP project in which we advised the concessionaire/project owner was the Kuala Lumpur Sentral project. This concerned the development of an integrated transport hub cum commercial development in Kuala Lumpur which provided, inter alia, a district energy system (for the distribution of electricity and water) to the buildings in KL Sentral. Since then, the firm has advised on projects involving dams, railways, highways, airports, power plants, tunnelling works, undersea cabling projects and other facilities. We have represented and are still representing the principal players in Malaysia’s infrastructure program – from suppliers of train carriages to builders of public housing to the Government. We are in a position to cover all transactional aspects of the projects, from the tendering phase to land acquisition to financing to design, construction & commissioning to operation & maintenance, as well as dispute resolution. The firm has particular experience in advising on railway projects such as the Light Rail Transit 3 System, the Mass Rapid Transit System (including the new MRT3 Circle line), the Rapid KL Monorail Fleet Expansion Project in the Klang Valley, the Electrified Double Track Rail System (Gemas to Johor Bahru) and lately, Phase 1 of the Klang Valley Double Track (KVDT-1) Electrification rehabilitation project. In regard to the new MRT 3 Circle line, we have been engaged to advise the project owner on the contracting and procuring structure for the entire project – advising, drafting and preparing the tender documents as well as the contracts for the appointment of the Project Management Consultant and, in due course, the Civil Main Contractors and System Turnkey Contractor. We have also been retained as adviser to RTS Operations Pte Ltd, which is the asset owner and operator of the pending Johor Bahru – Singapore Rapid Transit System. Our current overall scope of work is to represent/advise the client on the tender and award of all the packages for the construction of the system works and the system consultancy works – including preparing all documentation eg the contracts and tender documents. We are also responsible to advise on the appointment of the Independent Safety Assessor and on Enterprise Resource Planning. Besides railway projects, we also have experience, both in documentation and dispute resolution, in road/highway infrastructure projects, among which are the Damansara-Shah Alam Elevated Expressway (DASH) project and the West Coast Expressway (WCE) project.
