Partner – Dispute Resolution
Maidzuara is a litigator with extensive experience in corporate, commercial and civil disputes. Her current focus is on medical negligence cases, in relation to which she has appeared before the Court of Appeal and the Federal Court on numerous occasions. In 2017, Maidzuara, together with then-partner Darryl Goon, obtained a landmark judgment of the Federal Court in the process of representing 2 medical specialists who had been sued by a patient. The decision, besides being a favourable one for our clients, conclusively laid down the test for the standards of care owed by medical practitioners to their patients in respect of diagnosis, treatment and advice of risks. Before that, there had been 2 substantial but inconsistent lines of authorities, both in the High Court and Court of Appeal.
From time to time, Maidzuara lectures on medico-legal issues at the Penang Medical College (now known as the Royal College of Surgeons in Ireland (RCSI) and University College Dublin (UCD) Malaysia Campus). She is Co-Deputy Chairperson of the Advocacy Training Committee of the Malaysian Bar Council and is also the immediate Past Vice-Chair of the Legal Development and Training Committee of the Inter-Pacific Bar Association. In addition, she is one of the few members of the Malaysian Bar to have been appointed by the Chief Judge of Malaya to the Advocates and Solicitors’ Disciplinary Board, which is the apex body regulating and controlling all disciplinary actions against advocates and solicitors under the Legal Profession Act 1976.
